These Terms of Service govern your use of our hosting, VPS, and cloud infrastructure services. By accessing our Services, you agree to these Terms.
You agree not to use the Services for illegal activity, malware, phishing, DDoS attacks, unauthorized penetration testing, hosting illegal content, copyright infringement, spam, or abuse. Violations may result in immediate termination.
We do not guarantee uninterrupted service, zero downtime, zero data loss, or constant access. Services are provided “as-is” and “as available”.
You must maintain account security, protect credentials, monitor account activity, and comply with all policies. You are responsible for all actions under your account.
Services are billed in advance. Failed payments may cause suspension. Chargebacks result in termination. Voluntary contributions are not service payments.
We are not responsible for customer data loss, service interruptions, unauthorized access, third-party outages, or damages. Your sole remedy is to discontinue use.
Accounts may be suspended or terminated for ToS violations, non-payment, security risks, fraud, or resource abuse. No refunds are issued.
We may modify services, discontinue features, adjust resources, or update policies at any time.
These Terms are governed by the laws of the State of Wyoming, USA.
This Refund Policy applies to all hosting, VPS, and contribution payments.
All payments for VPS plans, hosting services, dedicated resources, add-ons, and upgrades are non-refundable. Resources provision instantly, so refunds cannot be issued.
No refunds for downtime, DDoS attacks, maintenance, performance issues, configuration errors, or user mistakes.
Voluntary contributions are final, non-refundable, and cannot be disputed or charged back.
Chargebacks without valid legal basis result in termination, suspension, blacklisting, and possible legal action.
If a payment is proven fraudulent, services may be suspended, verification required, and refunds issued only case-by-case.
Refunds may only be issued if required by Wyoming law or applicable regulations.

This Contribution Policy (“Policy”) governs all voluntary financial contributions (“Contributions”) made to support the development, maintenance, and expansion of the hosting, VPS, and cloud infrastructure services provided by ByteLayer LLC(“Company”, “we”, “us”, “our”).
By submitting a Contribution, you acknowledge that you have read, understood, and agreed to all terms below.
Contributions are entirely voluntary and made at the contributor’s sole discretion. They are not required to access any paid or free Services.
A Contribution does not constitute:
A purchase of services or products
A subscription fee
A contract for future services
Any form of commercial consideration
Contributions are not charitable donations, are not tax-deductible, and do not fall under nonprofit or charitable regulations.

Priority support
Additional resources
Faster deployment
SLA improvements
Exclusive features
A Contribution does not guarantee:
Feature development
Infrastructure upgrades
New services
Uptime commitments
Contributions do not provide:
Ownership or equity
Governance rights
Voting rights
Influence over strategic decisions
Contributions may be allocated to:
Infrastructure expansion
Security improvements
DDoS protection
Cloud scaling
Virtualization research
Software development
Operational costs
Documentation and support enhancements
The Company retains full discretion over fund allocation.
All Contributions are final, non-refundable, and non-reversible, including:
Accidental submissions
Changes of decision
Service interruptions
Dissatisfaction
User error
Contributors agree not to initiate chargebacks.
Unauthorized chargebacks may result in:
Account suspension or termination
Loss of service access
Permanent platform ban
Legal or collection actions under Wyoming law
We may screen Contributions for:
Fraud or unauthorized activity
AML/financial irregularities
High-risk or unusual behavior
We may request verification, decline, or reverse suspicious transactions.
A Contribution does not eliminate risks associated with:
Service outages or downtime
Security incidents
Cyberattacks or DDoS
Hardware failure
Third-party outages
Industry or market changes
Contributors accept all operational and business risks.
This contribution is classified as voluntary support under U.S. commercial law and does not constitute a charitable donation, investment, purchase, or any form of consideration.
Contributions do not provide exemption from:
U.S. federal regulations
Wyoming state statutes
Card-network rules
AML and anti-fraud frameworks
To maintain compliance with major U.S. payment processors, the contributor acknowledges:
The transaction is voluntary and non-obligatory
It is not tied to the delivery, performance, or purchase of any service
It is not an investment, prepaid service, subscription, or product purchase
No commercial rights or benefits are received in return
The contribution is final, non-refundable, and not subject to chargebacks
This classification ensures compatibility with:
Authorize.Net (card-not-present / 2D payments)
Elavon / First Data merchant requirements
Bolt.com operational and risk standards
The Contribution is recorded separately from hosting/VPS/cloud billing to comply with processor risk policies.
All payments are processed through PCI-DSS compliant payment processors (Authorize.Net, Elavon/First Data, or Bolt.com).

Full card numbers
CVV codes
Sensitive authentication data
We may update this Policy at any time.
Submitting a Contribution after an update constitutes acceptance of the revised terms.

This Risk Disclosure Statement (“Statement”) describes all potential risks associated with submitting a voluntary support contribution (“Contribution”). By making a Contribution, you acknowledge and accept these risks.
A Contribution does not guarantee service improvements, feature development, increased capacity, uptime guarantees, or performance gains. All enhancements remain at the sole discretion of the company.
Contributors have no influence over company policy, internal decisions, resource allocation, or infrastructure strategy.
A Contribution is not a financial investment, a loan, a security, or a financial instrument.
Contributors do not gain dividends, profit-sharing, equity, or capital appreciation.
Services may experience scheduled or emergency maintenance, performance fluctuations, outages or downtime, security incidents, network disruptions, or third-party outages. Contributions do not mitigate or eliminate these risks.
The company may modify its services, discontinue features, adjust pricing, restructure infrastructure, or experience industry challenges. Contributors accept these business risks fully.
Despite extensive security measures, risks exist including unauthorized access attempts, cyberattacks, DDoS events, data breaches, force-majeure events, or global infrastructure failures. Contributions do not reduce these risks.
We comply with U.S. law, Wyoming statutes, card network obligations, and AML/anti-fraud frameworks. Regulatory changes may impact operations. Contributions do not exempt the contributor or the company from legal obligations.
